A defendant shall be punished by imprisonment for not less than one year and six months.

except that the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The Defendant is a member of the “North Korea Literature,” a Suwon Regional Violence Organization, and is a member of the Mediation Division C after the “North Korea Literature.”

On February 27, 2014, the Defendant: (a) received physical punishment from the victim E (35 years of age) who is the cocoiner of the D Middle School; (b) contacted the F, G, H, I, and J, etc., who are the staff of the North D High School, with the order to mobilization the staff of the F, G, H, I, and J in order to assault the said E; and (c) visited the members of the F, G, I, I, and J, who are the staff of the North D High School, to gather the D Middle School in Suwon-gu, Suwon-gu.

피고인은 같은 날 22:00경 위 중학교에 위 C, 불상의 북문파 조직폭력배 1명과 함께 이르러, 위 C는 위 E을 발견하자 “E 이 개새끼 넌 죽어야 돼, 야 E 너 이제 나한테 어떡할거냐”고 욕설을 하면서 주먹과 손바닥으로 피해자 E의 얼굴을 20여 차례 이상 때리고 피해자 E이 씨름장 옆 급식소 앞으로 도망가자 피해자를 쫓아가 주먹과 무릎으로 피해자의 얼굴을 20여 차례 때렸고, C가 피해자 E을 때리던 중 CCTV에 폭행 장면이 찍히는 것을 피하려고 ‘잡아, 저새끼 씨름장으로 끌고 들어가’라고 지시하자 피고인은 피해자 E의 뒷덜미를 잡고 씨름장으로 끌고 들어가려고 한 후, 위 C가 ‘되는 애들 빨리 오라고 해라, 그거 가지고는 안 된다. 더 불러라’고 지시하자 피고인은 조직원들에게 전화를 한 후 위 C에게 상황을 보고하는 등 위협적 분위기를 조성하고, 위 C가 피해자를 학교 밖으로 데리고 나가 추가적인 폭행을 하려고 ‘이 새끼 차에 태워 묻어버리게 죽여 버리겠다’고 지시하자 피고인은 피해자 E을 차량에 감금하는 등 피해자를 위협하고, 피해자 E이 차량에서 내린 후 위 C가 ‘이 새끼 데리고 가서 손 좀 봐줘’라고 지시하자, 피고인은 불상의 조직폭력배 2명과 함께 피해자를 체육관 앞으로 끌고 가는 등 피해자를 위협하였고, 위 C가...
