A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment became final and conclusive.
Reasons
Punishment of the crime
As the representative director of E (main) who is an urban bus operator located in Busan metropolitan transportation Daegu D, the Defendant is a person in charge of overall business of the above company, and F is a person in charge of business management consulting or vicarious execution of various applications for national subsidies, etc. under the trade name "H" in 602 of the Busan Dong-gu G Building.
In order to promote the employment of the aged who are difficult to find employment or change their occupation, the Republic of Korea grants a certain amount of subsidy, i.e., subsidies for extension of employment of the aged, in proportion to the number of the aged who continue to work according to the abolition or extension of the retirement age.
In addition to the above F, the Defendant: (a) abused the fact that a public official in charge of granting subsidies for extension of employment of the aged submits the documents, such as the rules of employment, to verify the repeal and extension of the retirement age on the basis of the documents submitted by the public official upon receipt of evidentiary data on the requirements for payment; (b) received the above subsidies by means of extending the retirement age or by falsely preparing and submitting the rules of employment as if he abolished the retirement age; and (c) expressed that approximately
Accordingly, the above F shall prepare a written labor-management agreement stating that "The retirement age of E (E) is extended from 58 to 60 years of age on March 6, 2008, even if the retirement age was 60 years of age on March 6, 2008, even if the retirement age was extended from 58 to 60 years of age on March 6, 2008, the above F shall be extended from 58 to 60 years of age" in the above labor-management agreement. The defendant signed and sealed the representative of E (main) in the above labor-management agreement and signed and sealed the seal of the chairman of the labor-management agreement and submitted a written labor-management agreement to the staff of the Busan Employment Center by the method of submitting the above written labor-management agreement that was falsely prepared as above and submitted from November 19, 2013 to the day on which the crime list was entered.
