Reasons

Punishment of the crime

1. Violation of the Act on Special Measures for the Registration, etc. of Ownership Transfer;

A. On March 17, 2007, the Defendant prepared a false certificate of guarantee to the effect that “I, in the absence of a donation from the deceased, “G paper” of F forest land 75,967 square meters (hereinafter “the forest of this case”) at the time of Jung-Eup, Jung-Eup, the Defendant: (a) made a false certificate of guarantee to the effect that “I, as if I were to receive a donation from the owner (in the case of a different owner on the register: I will the other owner on the register) registered on the (forest: I) registry, grant a gift to the owner (in the case of a different owner on the register: I) and actually own it at present; and (b) made a false certificate of guarantee with their respective seals affixed thereon.”

C. On September 28, 2007, the Defendant was issued a copy of the confirmation required for the registration of transfer of ownership from the regular Eup market in a false manner after going through the procedure of public announcement of the issuance of confirmation based on the false guarantee submitted as set forth in paragraph 1(b) from the above regular viewing.

2. The Defendant, on September 28, 2007, submitted a false confirmation document to the public official in charge as referred to in paragraph 1(c), such as the Jeonju District Court and the branch court and Eup branch court, etc., in order to make the registration of ownership transfer as referred to in paragraph 1(a), and applied for the registration of ownership transfer and the registration of ownership transfer, thereby making the registration of ownership transfer as referred to in paragraph 1(a) be different from the actual record on the real estate register, which is a public electronic record.
