1. Basic facts

A. On December 28, 2015, the Defendant filed a petition with the Intellectual Property Tribunal for an affirmative trial to confirm the scope of right by asserting that the invention subject to confirmation falls under the scope of the right of claims under paragraphs (8) through (12) of the instant patent invention (hereinafter referred to as “claim 8 of this case”, and the remainder of claims is also the same in the same manner) of the instant patent invention (hereinafter referred to as “instant petition for trial”).

(2) After having deliberated by the Intellectual Property Trial and Appeal Board as 2015Da5740, the Intellectual Property Trial and Appeal Board rendered a trial ruling citing the instant request on August 23, 2016 on the ground that “an invention subject to confirmation falls under the scope of the right to the instant Claim 8 inventions or Claim 12 inventions.”
