1. Defendant A shall be punished by imprisonment with prison labor for one year.
However, the above sentence shall be executed for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. The Defendants’ co-principal, Defendant A, at the office located in the 2nd floor of the Busan Eastdong-gu, purchased a second cell phone from the victim Samsung Electronic Co., Ltd., and re-prefabricatedd with the victim’s registered trademark “SAP UNG” (registration number: H and I), which is the victim’s registered mobile phone parts, using domestic mobile phone parts similar to the product manufactured by the victim, so that they can be seen as new products, and then, Defendant B, Defendant C, and Defendant D are employees in charge of the business of re-prefabricated Samsung mobile phones under the direction of Defendant A from the above company.
No one shall sell, deliver, forge, imitate, or possess a trademark identical with or similar to another person's registered trademark for the purpose of using or making another person use such trademark on goods identical with or similar to the designated goods.
Nevertheless, the Defendants purchased Samsung mobile phones at low prices by using heavy domestic parts similar to those manufactured by the victim, such as liquid glass, turry, backer, carmer, chargeer, etc., which are part of the parts made by the victim's use of domestic parts, etc., which are similar to those of the new products, and conspired to distribute them through the mobile phone sales store and the Internet by putting them back into "SAM UNG", and putting them back into the box of the domestic mobile phone paper, which is the part made by the victim, as if they were newly shipped out with domestic mobile phone charging machines, descriptions, etc. in the box.
