Reasons
Punishment of the crime
1. From February 17, 2015, Defendant A and I: (a) from Seongbuk-gu Seoul Metropolitan Government J and II, the joint representative director of the K in charge of the K in charge of the manufacture, wholesale, retail, trade, etc. of electronic parts, etc.; (b) concluded a contract for the establishment of a trademark exclusive use license with Samsung Electronic Co., Ltd. or Samsung Water P Co., Ltd.; or (c) concluded a contract for the establishment of a patent exclusive use license with the aforementioned company to manufacture products using the above company’s registered trademark; (d) around February 17, 2015, Defendant A and I established the Seongbuk-gu Seoul Metropolitan Government J and two floors as its principal office and place of business; (e) set up the K in charge of the registration of the victim Samsung Electronic Co., Ltd. and the victim Samsung C Co., Ltd., Ltd., which are identical to the trademark registration (registration No. 0287141) to manufacture a new mobile phone charging, and (e) set up the trademark in order to charge the above Defendant Samsung PP.
Accordingly, on July 2, 2015, Defendant A manufactured and supplied 81,328 (a total of 481,680,220 won in the market price) of Samsung’s oil charging charging unit for Samsung from that time to May 24, 2017, using a copper plate manufactured in the plastic case of the jury charging machine in Nam-gu, Incheon, Nam-gu, Incheon, and received a delivery of KRW 20,227,298, as shown in the list of crimes in the attached Form 1.
Accordingly, Defendant A conspiredd with H and I to infringe on trademark rights of the victims.
2. Defendant C, Defendant D, and Defendant E, in collusion with I, have emerged as follows: (a) from October 14, 2015, I established and operated Seongbuk-gu Seoul Seongbuk-gu J and the second level; and (b) in the “SAm UNG” and “APLE”, a domestic or foreign famous trademark, from around October 14, 2015.
