Punishment of the crime
【Criminal Records of Crimes】 On December 3, 2008, the Defendant was sentenced to one year and four months of imprisonment with prison labor for special larceny, etc. at the Changwon District Court Jinwon Branch Branch on August 24, 201; one year and six months of imprisonment with prison labor for larceny; and four months of imprisonment with prison labor for larceny in the same court on January 18, 201; on July 8, 2014, the Defendant was sentenced to imprisonment with prison labor for a violation of the Act on the Aggravated Punishment, etc. of Specific Crimes at the Gwangju District Court on November 22, 2015.
[Criminal Facts]
1. On October 2, 2016, between 03:00 to 04:00, the Defendant and D, with the Defendant’s joint crime committed with the Defendant D, carried old electric wires, which amount to the total market price of KRW 4.890,00,00 in total, to be managed by the Defendant by moving off the cut old electric wires to the H Poter trucks where the Defendant and D had been on the part of the Defendant, and the Defendant carried 1,460km electric wires, which amount to the total market price of KRW 4.89,00,000, in total, from around 03:0 to 04:00.
Accordingly, the defendant and D stolen the victim's property together.
2. Joint crimes with defendants D or I;
A. On October 22, 2016, the Defendant, along with D and I from around 40 to 03:20 on October 10, 2016, left the above G Co., Ltd. factory, and the Defendant cut off electric wires prepared for the second floor through stairs, and I was cut off from the Defendant on the first floor of the above factory, and D was cut off from the Defendant, and D carried the cut electric wires with the Defendant and D as the truck in total at the market price of KRW 4,254,50,00 by moving the cut electric wires to the H Poter truck.
Accordingly, the defendant stolen the victim's property together with D and I.
B. On October 10, 2016, the Defendant, along with D and I, had a copper cable at a limited company C factory in charge of the management of the victim K located in Yong-gunJ, Nam-gun, Nam-gun, Nam-gun, Nam-gun, and I prepared the copper cable possessed by the Defendant in advance.
