◀2013고단2444 피고인 A는 대구 북구 O빌딩 2층에서 며느리인 P의 명의로 친환경농산물 인증기관인 ‘Q 주식회사’(이하 ‘Q’이라 한다)를 실질적으로 운영하는 자로서 위 Q의 인증심사원으로 활동하였다.

A has been delegated by the head of the National Agricultural Products Quality Management Service to perform certification work for environment-friendly agricultural products as above. As such, in accordance with the provisions of the Environment-Friendly Agriculture Fosterage Act and the Notice of the National Agricultural Products Quality Management Service Act, related data submitted by an applicant for certification shall be examined as to whether the relevant data meet the standards for certification. To this end, the above Q must confirm whether the agricultural products applied for certification are cultivated by visiting the farm by visiting the applicant and having interview the applicant, whether the cultivation area coincide, production plan and implementation plan, and if necessary to confirm whether the standards for certification are met, soil, farming water, and production are investigated and analyzed, and then the environment-friendly agricultural products are certified only to farmers meeting the requirements. However, in a situation where the certification institution for environment-friendly agricultural products is established on a nationwide scale of 78 (as of March 2013), there are many farmers running environment-friendly agricultural products, and its application is not many, and the general farmers who do not meet the above requirements are prepared with the above farming-related documents or have them falsely prepared, partly cultivated, soil, soil, etc.
