A defendant shall be punished by imprisonment for not less than eight months.
Reasons
Punishment of the crime
On October 24, 2014, the Defendant was sentenced to a fine of KRW 500,00 for larceny at the Busan District Court, and was sentenced to a fine of KRW 500,000, more than once.
1. On Nov. 1, 2013, the Defendant: (a) was placed in the shopping bags prepared in advance for a 490,000 Nos. 1 punishment in the holding price of the victim D, which was operated by the victim D in Busan Jin-gu, Busan, on the frontway operated by the victim D; and (b) was stolen.
From that time until May 24, 2015, the Defendant habitually stolen the property equivalent to 4,041,000 won in total from 15 times to 13 victims, as shown in the annexed list of crimes.
2. Embezzlements of lost possession;
A. On November 201, 2010, the Defendant: (a) discovered one cell phone of the 3 mobile phones owned by the victim F that was lost by the victim F, who was located far away from the floor at the Busan Donsan-dong, Busan 5-dong, Busan Donsan-do; and (b) did not follow necessary procedures such as reporting to the nearest police station, and (c) took one cell phone of the above mobile phone as he/she thought to have.
Accordingly, the defendant embezzled the property that has been separated from the possession of the victim.
B. Around March 2013, the Defendant: (a) discovered one resident registration certificate and one driver’s license, the owner of which was lost by the victim G at the bottom of the middle school fenced rice bed of the central middle school located in the Busan Seojin-gu, Busan, Seopo-gu; (b) reported to the police office near it; (c) did not take necessary procedures; and (d) took one resident registration certificate and one driver’s license in the above part; and (d) did not take necessary procedures, and (e) reported to the police office.
Accordingly, the defendant embezzled the property that has been separated from the possession of the victim.
C. On October 2013, the Defendant: (a) the victim H was lost on the bottom of the department store street, etc. located in the Busan Jindong-dong, Busan, on the first day of October, 2013.
