A defendant shall be punished by imprisonment for a term of one year and four months.

The Defendant shall pay 130,000 won to the applicant for damages.

Punishment of the crime

On June 22, 2016, the Defendant was sentenced to eight months of imprisonment for fraud, etc. by the Incheon District Court, and completed the execution of the above sentence on November 6, 2016.

1. On November 14, 2016, the Defendant purchased the Internet website “3 D. S. Game in the Republic of Korea” in the Republic of Korea on the Internet website.

The phrase “a notice to the effect that” is to be put up for KRW 133,00 by contacting the victim D and selling the said game machine in KRW 133,00.

A false statement was made.

However, since the defendant did not have the above game machine, even if he received 133,000 won from the injured party, he did not have the intent or ability to sell the above game machine to the injured party.

Nevertheless, the Defendant, as seen above, received KRW 133,00 from the injured party on the same day, she received KRW 133,00,000 from the injured party in the name of the Defendant, from the said day, to December 1, 2016, a sum of KRW 3,403,00 from the injured party, including the transfer of KRW 13,00,00 from the 27 victim, in the same manner as the 1st one of the attached Table 1.

2. Around November 14, 2016, the Defendant: (a) connected to “F”, a website; (b) deposited KRW 60,000 in the bank account (105-6030-76235) of the Plaintiff, a charging account of the said website; (c) charged the corresponding game money; (d) predicted the outcome of the domestic and overseas sports games through the said website to walk out the game money; and (e) returned the money in accordance with the fixed rate of distribution; and (e) if the amount of betting money was not paid to the said website operator, the Defendant deposited KRW 60,000 in the same manner until December 2, 2016, the amount of betting money was paid from that time to December 2, 2016.
