1. The defendant shall pay to the plaintiffs each amount stated in the "total sum of the amounts of award by plaintiff" in attached Form 5.
Reasons
1. Basic facts
A. The plaintiffs are those who were employed by the defendant on the "the date of entry by plaintiff" as stated in the attached Form 1 "the date of entry by plaintiff" and were retired from office as a driver, or have been employed until now, and are members of the National Transport Industry Trade Union. The defendant is a company with urban bus passenger transport business, etc. as its business purpose.
B. The wage agreement and the labor-management agreement 1) Each company of the Daejeon Metropolitan City Bus Transport Business Association to which the Defendant belongs and each branch of the Daejeon Metropolitan City Bus Workers’ Union affiliated with the Daejeon Metropolitan City Bus Workers’ Union affiliated with the Daejeon Metropolitan City Federation shall be the wage agreement of 2005, 2008, 2009, and 2010 (hereinafter “each of the instant wage agreements”).
The date of conclusion and application period are as follows. The labor-management agreement was concluded between February 1, 2005 and January 31, 2006 of the Wage Agreement (Provided, That the part not modified due to each labor-management agreement applies until January 31, 2008) between February 1, 2008 and January 31, 2006, and the labor-management agreement was concluded on May 30, 2008 to January 30, 2008 and January 31, 2009 (the above labor-management agreement was signed on February 1, 2008 to January 31, 2009 and the above labor-management agreement on January 31, 2009 to the Daejeon-gu Bus Workers' Union around October 31, 2010 and January 31, 2010 to the Daejeon-gu Daejeon Workers' Union around 206.
C. The main contents of each wage agreement and labor-management agreement of this case are 1) Work hours and labor-management agreement of 2005: Work hours are 44 hours a week in principle, and work hours are 26 days a month in 26 days (24 days a month in February, and 20 days a month in 26 days a month in principle.
The basic working hours shall be eight hours a day, four hours a day in the preceding day of a holiday, and the overtime hours shall be one hour a day, five hours a day in the preceding day, and the night work hours shall be 1/2 of the total of 0.5 hours a.m. and 1.5 hours a.m..
