피고인은 2013. 1. 9. 20:37경 목포시 C에 있는 피고인의 집에서 피해자를 비방할 목적으로 ‘plaync 리니지2’ 사이트(http://lineage2.plaync.co.kr/)에 접속하여 불특정 다수의 위 사이트 회원들이 방문하여 글을 열람할 수 있는 자유게시판에 사실은 피해자가 피고인의 동의하에 캐릭터를 공유하였을 뿐 피고인의 계정을 해킹한 사실이 없음에도 불구하고 “[잡담]D<<<=부주사칭 해킹 전문범”이라는 제목으로 “ㅋㅋㅋ 넌 예전이나 지금이나 똑같이 그러고 사냐. 니케릭 키워줄게 해놓고 계정 받아 뎀 이랑 아덴 꿀꺽하기. 어떻게 나이 먹어도 계속 그러고 사냐. 사내자슥이 애아빠가 대도 여전하네ㅋㅋ. E분들 D 이 파는 템 조심하세요 해킹물품입니다!”라는 내용의 글을 게시한 것을 비롯하여 별지 범죄일람표 기재와 같이 2013. 1. 9. 20:37경부터 2013. 1. 13. 20:12경까지 총 3회에 걸쳐 글을 게시하여 비방할 목적으로 정보통신망을 통하여 공공연하게 거짓의 사실을 드러내어 피해자의 명예를 훼손하였다.
