"2013 Highest 1629"
1. On August 2012, the Defendant forged private document: (a) at the office of “E Licensed Real Estate Agent” operated by D located in 109 of Songpa-gu Seoul Metropolitan Government building C building 109, the Defendant: (b) caused D to enter the said D into the “real estate lease contract, location of real estate: Songpa-gu Seoul Metropolitan Government: F 201; (c) deposit amount: KRW 201; (d) Sale million; G, name H, name H, and March 8, 2012; (c) printed out the private document and arbitrarily affixed a seal on the name of the said H.
Accordingly, for the purpose of uttering, the Defendant forged one copy of the lease contract on real estate in the name of H, which is a private document on rights and obligations.
2. On August 6, 2012, the Defendant: (a) borrowed money of KRW 20 million from I who was aware of the forgery in front of the apartment road of Songpa-gu Seoul, Songpa-gu, Seoul; and (b) exercised the forged real estate lease contract as if it was duly concluded.
3. The defrauded, at the time and place under the above paragraph 2, delivered one copy of the forged real estate lease agreement to the victim I, and the Defendant, as if he had a claim for the refund of the deposit for the 80 million won fake lease, was deceiving the victim.
According to the evidence duly adopted and examined by this court at the place under the above paragraph (2) around August 6, 2012 by the Defendant and the victim I received money on two occasions around August 6, 2012, the Defendant and the victim I dispute over the total amount actually received, and the victim I dispute over the amount of KRW 4.6 million, and the victim I dispute over the amount of KRW 20 million. On its own initiative, this part of the facts charged in this part is corrected by adding the phrase “within two times at the place under the above paragraph (2) on August 6, 2012.”
It received a total of KRW 20 million as a loan.
