Reasons
Punishment of the crime
[Criminal Power] On August 19, 2010, the Defendant was sentenced to three years of imprisonment for a violation of the Act on the Aggravated Punishment, etc. of Specific Crimes by the Incheon District Court, and the execution of the said sentence was terminated on July 1, 2013.
【Criminal Facts】
1. Embezzlements of lost possession;
A. On August 3, 2013, at around 16:00, the Defendant acquired one half-story for male screening in the market value equivalent to KRW 70,000, in the Central Park of the Incheon Central Culture and Arts Center, which was located in 1408, Nam-gu, Incheon Metropolitan City, 1408.
The Defendant did not take necessary procedures, such as returning the acquired property to the victim, but did so.
Accordingly, the defendant embezzled the property that has been separated from the possession of the victim.
B. On August 12, 2013, around 04:30 on August 12, 2013, the Defendant acquired a part of the Casbee transportation card lost by a victim who is unable to know his/her name in Nam-gu Incheon Metropolitan City D.
The Defendant did not take necessary procedures, such as returning the acquired property to the victim, but did so.
Accordingly, the defendant embezzled the property that has been separated from the possession of the victim.
C. On August 16, 2013, at around 14:50, the Defendant acquired five credit cards (CJ card, new physical check card, citizen card, national physical check card, corporate bank check card) of the victim F that was abandoned in the public toilets in the central park of the Incheon Central Culture and Arts Center located in 1408, Nam-gu, Incheon Metropolitan City.
The Defendant did not take necessary procedures, such as returning the acquired property to the victim, but did so.
Accordingly, the defendant embezzled the property that has been separated from the possession of the victim.
2. Fraud by using computers, etc.;
A. On August 16, 2013, the Defendant is a victim at the Incheon Integrated Terminal located in 15, Chungcheongnam-dong, Nam-gu, Incheon, Incheon, at its location.
