A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
"2017 Highest 930"
1. On October 12, 2016, the Defendant, at the Defendant’s house located in Mapo-gu Seoul Metropolitan Government C and 402, posted a notice stating that he/she sells IDs on the Internet “China and High Republic” car page although he/she did not have an intention or ability to sell DNAs, and then reported and contacted the above writing to the victim D, “on the first hand, if he/she transfers the price of the goods, he/she will immediately deliver it on the day.”
‘Falsely speaking, 720,000 won was remitted from the injured party to the national bank account (E) in the name of the defendant as the price for the goods on the same day.
2. On October 13, 2016, the Defendant, at the home of the above Defendant, posted on the Internet “China and High-Tech” car page in which he did not have the intention or ability to sell the so-called “the so-called “the first remittance of the price of the goods” to the victim F who reported and contacted the above writing, and immediately delivers the so-called “the so-called “the first remittance of the price of the goods will be made” to the Defendant F.
"Falsely speaking," one million won was remitted from the injured party to the above national bank account in the name of the defendant as the price for the goods on the same day.
Around November 20, 2016, the Defendant posted a notice on the Defendant’s house located in Mapo-gu Seoul Metropolitan Government C and 402 on November 20, 2016, stating that he/she sells a new job on the Internet “China” car page, despite having no intention or ability to sell a DNA, and that he/she immediately delivers a DNA car page to the victim G who reported and contacted the above writing.
‘Falsely speaking, it received 700,000 won from the injured party to the new bank account (E) in the name of the defendant under the same day as the price for the goods on the same day.
