A defendant shall be punished by imprisonment for six months.
Reasons
Punishment of the crime
[Criminal Power] On December 30, 2014, the Defendant was sentenced to three years and six months of the suspension of execution on January 7, 2015, and the said judgment became final and conclusive on December 7, 2015.
【Criminal Facts】
The Defendant is the head of the branch office of the National Democratic Labor Union Federation EF Trade Union F branch (hereinafter referred to as the “F branch”), G, H, I, J, K, and L (each of the foregoing days on the same day) composed of workers at the construction site of C’D 1 and 2 located in the chemical power plant located in the company B, and M, N, andO (each of the foregoing days on the same day) are the employees of the above F branch, and M, N, andO (each of these days on the same day) are the general workers of the above F branch.
The F branch asserts that P, with respect to the construction work of the V power plants in U located in the V station that is implemented by T, composed of Q, R, and S, Co., Ltd., Ltd., the F branch, without employing local residents, selected labor union members belonging to the Korea Labor-General, was employed, and that W “W” assembly was held before the construction site of the above V power plant.
1. Around 08:00 on July 8, 2014, the Defendant: (a) held a “W” assembly with approximately 100 labor union members affiliated with the F branch in the presence of approximately 500 labor union members affiliated with the F branch from the fixed door at the construction site of the said V-power plant; (b) requested a interview with the R-site commander, but did not accept the request, and (c) attempted to instigate the above union members to enter the construction site of the said V-power plant; and (d) around 09:0 on the same day, 50 union members collected at the same place using the microphone connected to the broadcasting vehicle to enter the construction site of the said V-power station; and (b) ordered the labor union members to enter approximately 500 members of the labor union who were gathered at the same time using the microphone connected to the broadcasting vehicle to enter the above construction site.”
Accordingly, approximately 50 members of the above Trade Union and Labor Relations Adjustment Board are moving to the direction of the construction site. G, H, I, J, K, L, etc., which were in the two ties.
