Punishment of the crime

The Defendants are married, and the Defendants and C, the complainant, around 200, were married to the same high school and became aware of each other, and they were known to the parents until now. The Defendants and C loaned money to C on the condition that 2-3% of the monthly interest rate is paid from around 2005 to July 2010.

No person who collects claims shall engage in any act seriously disturbing privacy or peace in business by repeatedly demanding any person, other than a debtor, who does not have any legal obligation to repay a debt on behalf of a debtor to arouse fear or apprehension.

1. 피고인 A 피고인은 2012. 8. 28.경 C의 딸 D의 근무지인 서울 종로구 E을 방문하여, “니네 엄마,아빠가 돈을 나한테 어마 무시하게 꿔간거야, 그런데 안주는 거야”, “너한테 달라고 하는 건 아니지만 통보는 해야 될거 아니야”, “내가 니네 신랑한테도 가서 다 얘기 할거야”, “ 내가 돈이 한두 푼인줄 알아 계산을 해보니까 한 3억 6,000도 넘어 그리고 다 거짓말이더구먼 니네 아빠“, ”니네 자식들한테는 내가 빛을 얘기를 해야되지 않냐“라고 말을 하였고, 2012. 8. 29경 C의 사위 F의 근무지인 서울 서울 중구 G 부근 상호 불상의 커피숍 안에서 F에게 “이집이 완전 있지 사기꾼이네”, “D이네 대해서 이야기를 하면 기절할 게 한두 가지가 아닐 것”, “H이 까불고 있어”라고 말하고, 2012. 8. 29. 오후 8:20경 F에게 전화하여 “그 새끼 H이 나한테 I여대 그 13년전에 교수라고 그랬어”, “ H이 한테 바로 전화해 지금”, “H이한테 바로 사기꾼이야 그 새끼, 그년은 더 사기꾼이고”, “내가 탄원서 다 쓸거야 내가 그거 회사로”, “저 년 다 사기꾼이야”,"자네 아버지 한테 다 해놨다
