Basic Facts
The defendant is a legal entity that establishes and operates the C College, and the plaintiff has been working as an employee of the defendant from March 1, 2005.
The main contents of the defendant's articles of incorporation and enforcement rules on the remuneration of employees, and the remuneration regulations for teachers are as follows.
Remuneration of teachers under Article 47 (Remuneration) shall be prescribed by the Rules following a resolution of the board of directors in accordance with qualifications, careers, and the degree of difficulty and responsibility of duties.
Article 75 (Remuneration) The remuneration of general employees shall be determined separately by the rules, subject to the resolution of the board of directors according to the class and continuous service period, to be proper according to the degree of difficulty and responsibility of duties, considering the standard living cost of the general public, the wages of civilians
Article 18 (Remuneration for School Personnel) (1) of the Enforcement Rule of the Criminal Procedure Act shall apply to the remuneration of school personnel in accordance with the remuneration regulations for State public officials, but it shall be separately prescribed by the Rules following a resolution of the board of directors according to the degree of difficulty and responsibility of qualifications
(2) The remuneration of general employees shall correspond to the remuneration regulations for State public officials, but it shall be separately prescribed by the rules, subject to the resolution of the board of directors according to the degree of difficulty and responsibility of duties, class and continuous service period, considering the standard living expenses of the general public, the wages of civilians, etc.
Provided, That the remuneration of the general staff of the corporation shall also be corresponding thereto.
The defendant shall be paid a performance bonus to the staff of Article 12 (Performance Bonuses) of the Regulations on the Remuneration of Public Officials in accordance with Article 7-2 and attached Table 2-2 of the Regulations on the Allowances, etc. for Public Officials.
Article 16 (Overtime Work Allowances) A overtime work allowance shall be paid to persons who have worked outside of working hours prescribed by an order of service under Article 16, under Article 15 of the Regulations on Allowances, etc. for Public Officials
The method of payment shall be 15 hours per basic hour, and additional payment shall be between 15 and 60 hours per month.
Article 23 (Compensation for Annual Leave) Employees shall be governed by Article 18-5 of the Regulations concerning Allowances, etc. for Public Officials.
