Defendants shall be punished by imprisonment for six months.
However, each of the defendants is sentenced to the above punishment for one year from the date of the final judgment.
Reasons
Punishment of the crime
1. No one may change the odometer of a motor vehicle.
Nevertheless, Defendant A, at around November 17, 2017, at the D University parking lot located in Synju-gun upon Defendant B’s request from Defendant B to manipulate the odometer, left the meter board of Defendant B’s vehicle E, and was connected to the meter chip in order to arbitrarily manipulate the odometer from 167,000 km to 15,000 km from the meter board, and received KRW 120,000 in return.
As a result, the Defendants conspired to change the mileage of the vehicle.
2. On November 2015, Defendant A received KRW 250,000 from F, and received a request from F to operate the odometer, Defendant A left the strawing hall in the H funeral hall parking lot located in G in G in G in Y, and changed the odometer from 110,000 km to 1,000 km in a way as described in paragraph (1), and then changed the odometer by arbitrarily manipulating the odometer from 110,000 km to 1,000 km in the same way as described in paragraph (1). From then to May 25, 2017, Defendant A changed the odometer by 74 times in total at the request of the accomplices listed in each list of crimes, as described in the list of crimes.
3. On April 2, 2018, Defendant B sold Echier HG automobiles that operated the odometer as described in paragraph 1(a) at the J Trading Co., Ltd. at Seosan-si, Seosan-si, and sold the said vehicle upon receiving KRW 11,80,000 from the victim, as it concealed the operation of the odometer, and as it was a normal vehicle.
Accordingly, the defendant was given property by deceiving the victim.
