Defendant
A shall be punished by imprisonment with prison labor for six months and by imprisonment for four months.
However, from the date this judgment became final and conclusive, Defendant.
Reasons
Punishment of the crime
[criminal history] On January 19, 2016, Defendant B was sentenced to a suspended sentence of three years for the crime of violating the Road Traffic Act at the Daejeon District Court on August 27, 2016, and the judgment became final and conclusive on January 27, 2016. On April 11, 2016, Defendant B was sentenced to imprisonment with prison labor for one year for the same crime of violating the Act on the Aggravated Punishment, etc. of Specific Crimes (Death and Injury caused before the risk) at the same court, and the judgment became final and conclusive on July 2, 2016.
[Criminal facts]
1. No defendant A or B shall change the odometer of his/her motor vehicle;
Nevertheless, on July 2014, the Defendants prepared equipment to operate the odometer and conspired to change the odometer to those who demanded to change the odometer and to have the proceeds divided.
A. On July 2015, the Defendants: (a) requested D and E to change the mileage of HG car from F F to less than the actual mileage; (b) received the meter board of the said car sent on a door-to-door basis; and (c) changed the odometer from 70,000 km to 60,000 km using the odometer.
Accordingly, the Defendants conspired with D and E to change the mileage of the vehicle.
B. On August 20, 2015, at around 14:00, the Defendants requested G to change the mileage of H-to-surd vehicle from G to the distance lower than the actual mileage on the front of the mutually unfolded her trade name in the area near Daejeon Daejeon, Daejeon, and changed the odometer from 199,720km to 9,720km by using the odometer operator.
Accordingly, the Defendants conspired with G to change the mileage of the vehicle.
2. No person who is a defendant A shall change the odometer of a motor vehicle;
A. On March 10, 2016, the Defendant: (a) requested from J to change the mileage of K5 vehicles and LK5 vehicles from KJ at the G Apartment-gu I apartment parking lot of Daejeon Sung-gu, Daejeon on March 10, 2016; and (b) used the odometer operator to change the mileage of K5 vehicles and LK5 vehicles below the actual odometer.
