All of the prosecutions of this case are dismissed.

1. Summary of the facts charged

A. On May 25, 2012, the Defendant, in violation of the Act on Promotion of Information and Communications Network Utilization and Information Protection, etc. (Defamation) published a letter on the bulletin board for the item “(State...... shares are and were frighted in the Company..... whether to faithfully think of money in this business?” on the following grounds: (a) the Defendant, the Defendant’s dwelling at the window B of Changwon-si, the Defendant’s dwelling at the window B of Changwon-si, was connected to the Nos. 701, an Internet site, the victim’s website.

However, there was no fact of price manipulation.

From around that time to August 31, 2012, the Defendant, along with this, posted a false statement via the aforementioned method 24 times in total, and damaged the reputation of the victim by openly exposing false information through an information and communications network for the purpose of slandering the victim.

B. At around 10:25 on June 21, 2012, the Defendant published a letter “In the same manner as paragraph (a) in the same place as Paragraph (1) in the same manner as Paragraph (1).”

(2) 피고인은 2012. 8. 21. 14:41경 가항과 같은 장소에서 가항과 같은 방법으로 “어제 매도 안 했으면 오늘 또 기분 잡친 뻔했다. ㅋ 문어대가리가 관계기업하고 드디어 청산이다 오늘로 흘러내리는게 맨날 반복이다. 저런 인간이 주인인 회사 멀 기대하는가 ”라는 글을 게재하였다.

Accordingly, the defendant openly insultingd the above victim two times.

2. Of the facts charged in the instant case, a charge of violating the Act on Promotion of Information and Communications Network Utilization and Information Protection (Defamation) is a crime falling under Article 70(2) of the same Act, and cannot be prosecuted against the victim’s express intent under Article 70(3) of the same Act. The record reveals that the victim shall be punished against the Defendant after instituting the instant prosecution.
