A defendant shall be punished by imprisonment for not more than ten months.
However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
On September 6, 2007, the Defendant was issued a summary order of a fine of four million won for a violation of the Road Traffic Act (drinking driving) at the Busan District Court's Dong Branch, and on March 31, 2010, the Defendant was sentenced to a suspended sentence of two years for a period of six months by the same court.
1. Notwithstanding the fact that the Defendant violated Article 44(1) of the Road Traffic Act twice or more times, the Defendant driven a B-hand car with alcohol concentration of about 100 meters from the section of approximately 100 meters to the road in the same Dong and Dong around December 22:10, 2016, at around 22:10, the Defendant driven a vehicle with low alcohol content of at least 0.082% in alcohol in his/her blood.
2. The Defendant violated the Act on Special Cases Concerning the Settlement of Traffic Accidents (Bodily Injury) is a driver of a motor vehicle with the highest level of bid B. On December 1, 2016, at around 22:10, the Defendant driven the said motor vehicle while under the influence of alcohol, such as the foregoing paragraph 1, and driven the said motor vehicle at an irregular speed, along with two-lane distance from the border side of the city in which the said three-lane would run along the same speed.
At night and at the front of that place, signal lights and crosswalks are installed. In such cases, the driver had a duty of care to reduce the speed to the person engaged in the driving duty and to ensure the movement of other vehicles on the signal lights and frontway, whether pedestrians are crossingd, and to prevent accidents in advance.
Nevertheless, the Defendant, while under the influence of alcohol, neglected to do so and did not keep the front at a speed while driving in the same way as that of the electric road, received as the front part of the vehicle operated by the Defendant after the halog golf car driven by the victim C (V, 42 years old) waiting in the same way as that of the electric road.
Ultimately, the defendant is in need of approximately two weeks of treatment due to the above occupational negligence.
