Defendant
A A shall be punished by a fine of KRW 3 million, and Defendant B shall be punished by a fine of KRW 4 million.
The above fines are imposed by the Defendants.
Reasons
Punishment of the crime
No person shall defame any person who intends to become a candidate or candidate by openly pointing out facts through a speech, broadcast, newspaper, communications, magazine, poster, propaganda document, or any other means, or slander his/her spouse, lineal ascendant or descendant, or sibling, with the intention of prohibiting him/her from being elected or not elected.
Nevertheless, in the election of the 19th National Assembly member that was implemented on April 11, 2012, the Defendants were willing to slander D intended to be a candidate by openly pointing out facts on the Internet bulletin board, etc. for the purpose of preventing D from being elected in the constituency of the 19th National Assembly member.
1. Defendant A connected to Twitter by means of a mobile phone and computer on February 29, 2012, with the purpose of preventing the election of D from being exposed to Twitter, Defendant A, “I do not have time and time,” and Defendant A, with the intention of preventing the election of D from being exposed to Twitter C, by openly pointing out facts by posting each letter of D through Twitter, as shown in attached Table 1, from around that time to March 11, 2012.
2. Defendant B
A. On February 29, 2012, Defendant B visited D’s economic bulletin board by means of computers at HPC rooms located under the ground of the building in Seongbuk-gu Seoul Metropolitan City, Sungnam-si, with a view to preventing the election of D from being opened as a candidate for a party branch of the subdivision C?
