[Defendant A] The defendant shall be punished by imprisonment with prison labor for a year and April.

Punishment of the crime

[Criminal Records] Defendant A was sentenced to eight months of imprisonment with labor for a violation of the Narcotics Control Act in the Busan District Court’s Branch on August 19, 2016, and the judgment became final and conclusive on February 16, 2017.

[Criminal facts] Defendant A sold and administered narcotics as follows even if he is not a handler of narcotics.

1. On July 30, 2015, at around 03:00, the Defendant inserted approximately 0.1g of mert mpacters (i.e., one philopon; hereinafter “philopon”) with F in a guest room in Gangnam-gu Seoul Metropolitan Government’s “E hotel”, into a single-use injection machine, dilution with a non-use, and administered them by means of injection into the ymptopoma.

2. On August 15, 2015, the Defendant, at the house of G apartment No. 1415 at Ansan-si around 09:00, administered approximately 0.1g of philopon with F in a single-use injection machine, dilution with cropopon, and administered them by means of injection into the cropopum drums.

3. On August 15, 2015, the Defendant: (a) transferred KRW 400,000 to the F bank account (Account Number: H) in the F’s name upon the request to request F to seek writingphone at a place where it is not known at around 20:56, and (b) received approximately 0.75 grams from F from the house of the F on the same day at around 21:30 on the same day.

4. On August 22, 2015, the Defendant transferred KRW 200,000 to F’s post office account (Account Number: I) in the F’s name upon request to request F to rescue phiphones at a place where it is unknown at least 12:12 on August 22, 2015, and around that time, from F’s house, approximately 0.5g of phiphones from F.

5. On August 25, 2015, at around 15:11, the Defendant received 1 million won from a new bank account (Account Number: L) in the name of the Defendant’s mother in the name of the K (parent) for Defendant’s use. On the same day, around 23:55, the Defendant sold approximately 0.7 gramopon to the said J via F on the front side of the “N hotel” in Seocho-gu Seoul Metropolitan City on the same day.

6. On August 30, 2015, the Defendant: (a) requested F to rescue phiphones from a place where it is not known at around 18:12 on August 30, 2015; and (b) 400,000 won to a post office account in the above F.
