Punishment of the crime

[Fact-finding Facts] B held office as the head of the Trade Union of Busan Metropolitan City (State), from August 1, 2001 to August 31, 2016, and concluded with the company and labor-management council on behalf of the branch in accordance with the rules of the National Federation of Local Bus Workers on behalf of the branch, and entered into a wage negotiation and various group agreements on behalf of the members through labor-management consultation with the company and the labor-management council. In particular, E is a person with the authority to recommend employees to the company at the time of hiring regular workers and re-contract with the contracting affiliated members. On April 2016, the Defendant and J promised to recommend the above B to be employed as a bus engineer at the D Nowon-gu Office located in Busan Shipping Daegu, Busan, and to give the above B KRW 10 million in return for soliciting the employment of the bus engineer to the above B.

around April 2016, the J received 10 million won in cash from the Defendant at the 1st mobilization of the articles of incorporation, which is located in the 4th 139 U.S., Busan District Office, for the 10 million won in return for employment, in collusion with J on the ground that the Defendant provided the 10 million won in return for employment from the D's office of investigation in the same month.
