The prosecutor's appeal is dismissed.

1. The summary of the grounds for appeal is that the Defendant administered narcotics, such as penta, etc., which can mitigate pains in order for patients who are sensitive to pain to undergo constant surgery, in light of the following: (a) the Defendant administered narcotics, etc., even though it is not in principle required to anesthesia by narcotics, etc.; (b) the Defendant administered narcotics, etc., even though it is not required to do so; and (c) the patient did not explain the side effects such as the dependence on injection of narcotics, etc.; and (d) the Defendant administered narcotics, etc., such as penta, etc., to ensure that patients who are sensitive to pains continuously undergo the surgery; and (b) the Defendant administered narcotics, etc. or psychotropic drugs for purposes other than their duties.

Although it is sufficient to view the defendant, the judgment of the court below which acquitted the defendant is erroneous and has affected the conclusion of the judgment.

2. Determination

A. The summary of the facts charged in the instant case shall not administer narcotics or psychotropic drugs for purposes other than their duties.
