A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The defendant is the spouse of D who registered as a preliminary candidate for C/Gun in the 7th simultaneous local elections conducted on June 13, 2018.

No person shall publish any false information about a candidate, his/her spouse, etc., in a manner unfavorable to a candidate (including a person who intends to become a candidate) by means of a speech, broadcast, newspaper, communication, magazine, poster, propaganda document, or other means, with the intention of preventing him/her from being elected, and slander any candidate, his/her spouse, lineal ascendant, descendant, or sibling by openly pointing out a fact.

1. On May 17, 2018, the Defendant committed a crime on May 17, 2018, at G cafeteria located in F before around 19:30 on May 17, 2018, the Defendant visited the said members at the G cafeteria, which is a spouse of H of the prospective candidate for C/Gun, while attending a meeting of friendly gathering and providing meals together with 19 members.
