Defendant shall be punished by a fine of KRW 80,000.

If the defendant does not pay the above fine, 100,000 won shall be one day.

Punishment of the crime

On March 2, 2018, the Defendant registered as a preliminary candidate for the election of Do Council Members (B constituency) at the 7th simultaneous local elections nationwide conducted on June 13, 2018, and was a person who registered as a candidate on May 24, 2018, but fell.

No person shall publish false information about the place of birth, family relation, status, occupation, career, etc. of a candidate, the spouse of the candidate or his/her lineal ascendant or descendant, or his/her organization, or whether he/she has supported a specific person or specific organization, etc., in favor of a candidate (including a person who intends to be a candidate) by means of a speech, broadcast, newspaper, communication, magazine, poster, propaganda document, or any other means, with the intention of getting elected or having another person elected.

Nevertheless, on March 2, 2018 to June 8, 2018, the Defendant distributed and posted the Defendant’s application for registration of the Defendant’s candidate and the Defendant’s preliminary candidate, the promotional materials for the preliminary candidate (2,100 pages), the name cards (3,000 pages for the preliminary candidate, and the name cards of the candidate), and the Defendant’s career books for public relations relations (61,844 pages) in the “career column for the Defendant’s career of the Defendant of the nine media,” stating that “(former) director of the Blue Office C division for the President and the President Blue Office.”

However, in fact, the Defendant only worked for the Secretary Office C of the Cheong-dae President on May 12, 2015 to June 30, 2017 as an "administrative staff (class VII equivalent)" and at the time, there was no position as "the director" in the Secretary Office C of the Cheong-dae President B at the time.

As a result, the Defendant published false facts about career, etc. for the purpose of election as a candidate or candidate.

Summary of Evidence

The current status of public relations, such as the defendant's prosecutor's office against some of the defendant's statutory statements, copies of the preliminary candidate's publicity materials, copies of the report for sending text messages, applications for preliminary candidate registration and copies of the application for candidate registration, promotional materials, etc., and the election office.
