1. The Defendant’s disposition of exclusion from promotion against the Plaintiff on July 1, 2014 shall be revoked.

Reasons

In light of the above legal principles, the court below erred by misapprehending the legal principles as to the promotion of candidates for promotion, and thereby exceeding the bounds of the principle of free evaluation of qualification, and thereby exceeding the bounds of the principle of free evaluation of qualification, and thereby exceeding the bounds of the principle of free evaluation of qualification, as otherwise alleged in the ground of appeal.
