A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

Criminal facts

피고인은 2017. 6. 15. 경 ‘ 위 챗’ 이라는 휴대폰 채팅 프로그램을 통해 위 전화금융 사기단 조직원인 성명 불상자( 일명 ‘B’ )로부터 은행 계좌 명의 자로부터 체크카드를 교부 받아 전달해 주면 그 대가로 수고비를 주겠다는 제안을 받고 이를 승낙한 후, 2017. 7. 7. 경부터 2017. 7. 17. 경까지 위 성명 불상자의 지시에 따라 은행 계좌 명의 자로부터 체크카드를 교부 받아 위 전화금융 사기단 조직원에게 전달하는 방법으로 아래와 같은 범행을 하였다.

Nevertheless, according to the above “B”’s order, the Defendant: (a) around July 7, 2017, issued 18:30 to D’s residence in Gangnam-si, Gangnam-gu, Gangnam-gu; (b) from D’s account at D’s 10th floor in Gangnam-gu, Seoul; and (c) delivered 12/10 of D’s e-mail card from D’s 10th floor to the name influence; and (d) thereafter, from around that time.
