2. 공무집행 방해 피고인은 위 제 1 항과 같은 장소에서 위 제 1 항과 같은 이유로 112 신고를 받고 출동한 부산 연제 경찰서 F 지구대 소속 순경 G이 피고인이 위 클럽 입구 바닥에 드러누워 위 E에게 “ 씹할 놈 아, 개새끼야” 라는 등의 욕설을 하며 발길질을 하고 있는 것을 보고 피고인을 진정시키자, “야 이, 씨 발 놈 아, 내 아들이 너만 하다, 개새끼야 씨 발 놈아, 내가 뭘 잘못 했노” 라는 등의 욕설을 하며 발로 위 G을 걷어차려고 하고, 외투로 그의 얼굴을 1회 내리치고 손바닥으로 위 G의 뺨을 1회 때리고, 계속하여 같은 날 23:10 경 위 F 지구대에 현행 범인으로 체포되어 온 후 “ 내가 뭘 잘못 했노, 씨 발 놈들 아, 개새끼들 아” 라는 등의 욕설을 하고, 휴대폰과 핸드백을 집어던지는 등 소란을 피워 위 지구대 소속 경장 H이 진정하라며 이를 제지하자, 그에게 “ 이 좆 만한 새끼야, 니가 뭔 데 이래라

저 래라 하 노, 가만히 안 있으면 어쩔 껀 데 ” 라는 등의 욕설을 하며 손톱으로 위 H의 왼손 손등을 할퀴는 등으로 폭행하여 위 G 과 위 H의 112 신고 업무 처리 등에 관한 정당한 직무집행을 방해하였다.
