1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Facts of recognition;
A. The Defendant is a juristic person operating D University, a junior college, at Jeju City, D University (hereinafter “Defendant School”).
Since the Plaintiff was newly appointed as a music member and a full-time lecturer at Defendant School on March 1, 1998, the Plaintiff was in a position of assistant professor from March 1, 2012.
B. On December 31, 2014, the Defendant notified the Plaintiff of the instant disposition stating that “The average points of the Plaintiff’s teaching staff evaluation during the term of appointment pursuant to Article 52-2 of the Private School Act and Article 9-3 of the Regulations on the Appointment of Teaching Staff of Defendant School do not constitute grounds for refusal to be reappointed to less than 60 points.”
C. The parts related to this case in the rules of the defendant are as follows:
Article 39-8 (Appointment of Teachers on January 1, 2002, who were appointed as a fixed-term worker under previous provisions) (1) In case where a teacher in office is reappointed on January 1, 2002 due to the expiration of his working period, he shall be appointed with a fixed working period in accordance with the following criteria, but if he wishes, the provisions of Article 39-6 of the Articles of Incorporation shall apply:
1. Professors: The period from the retirement age under Article 47 of the Public Educational Officials Act;
2. Associate professor: Six years;
3. Assistant professors: Three years. (2) The chief director shall examine whether he/she is reappointed at the request of a teacher whose working period expires;
(3) Detailed standards and procedures for the review under paragraph (2) shall be determined after deliberation by the teachers' personnel committee.
(6) The president shall evaluate the achievements of education, research, etc. of faculty members.
(7) The chairperson shall reflect the results of evaluation of achievements under paragraph (6) in the examination under paragraph (2).
(8) To ensure that the evaluation of achievements is conducted fairly and objectively, the president shall determine matters concerning the criteria, methods, procedures, etc. for evaluation after deliberation by the Teachers' Personnel Committee.
