Punishment of the crime

1. On April 13, 201, Defendant A was sentenced to a fine of two million won for a violation of the Road Traffic Act (driving) at the Seoul Central District Court on April 13, 201, and was sentenced to a fine of 1.5 million won by the same court on May 22, 2008.

On December 24, 2013, at around 21:50 on December 24, 2013, the Defendant driven C Abcom motor vehicle under the influence of alcohol with a blood alcohol concentration of about 0.117% at approximately 10 meters from the front of the restaurant “Mapo-dong” in the long-term city of Kimpo-si to the front of the same “Dominian” road.

B. When it was discovered that the Defendant driven a vehicle while drinking alcohol as stated in the preceding paragraph, the Defendant had tried to escape from criminal punishment by stating that he driven a vehicle on behalf of the Defendant to the subordinate in the same workplace.

On December 30, 2013, at around 15:00, the Defendant requested B to “A while attending the police and making a statement that he had driven instead of the police,” and asked B to do so.

B was present at the Kimpo Police Station on January 2, 2014 upon the request of the defendant and stated the case falsely to E as if he driven the vehicle at the time and place specified in the preceding paragraph.

As a result, the defendant instigated B to escape from the criminal.

2. Defendant B along with Defendant A is a part of the work of Defendant A, who works in the Kimpo-si D apartment sales office in Kimpo-si.

The above A, as described in paragraph 1(a), was engaged in drinking driving, and the defendant was also aware of such fact.

The Defendant, as above, was aware of the fact that the Defendant committed a crime corresponding to a fine or heavier punishment, but on his/her own behalf, made a statement as if he/she was driving at the same time and received the request from A, and completed the case to E at around January 13:44, 2014.
