1. The defendant shall pay to the plaintiffs each share of 1/2 of co-owners of each real estate listed in the separate sheet.
Reasons
1. Facts of recognition;
A. On August 20, 2016, the Plaintiff is the heir of the deceased deceased’s children.
B. The total share transfer registration in the name of the deceased was completed with respect to the share of co-owners of the real estate listed in the separate list No. 1. However, the full share transfer registration was completed on January 29, 201, No. 5901, which was received on January 29, 2016, for sale on January 5, 2016.
C. The entire share transfer registration in the name of the deceased was completed with respect to the share of co-owners in the real estate listed in the separate list No. 2, but the registration for the entire share transfer registration was completed as of July 20, 2015 by the receipt of No. 61876, Jul. 23, 2015, under the Defendant’s name as of July 20, 2015. The registration for the entire share transfer registration was completed as of January 29, 2016 by the receipt of No. 5899, Jan. 29, 2016, as of January 5, 2016.
On July 20, 2015, the Defendant completed the above provisional registration and the entire transfer registration of each of the above shares (hereinafter referred to as “each of the above shares transfer registration of each of the above shares”) based on the purchase/sale reservation (No. 9-1) and the real estate sales contract (No. 9-5) on July 20, 2015 with respect to each real estate listed in the attached list (hereinafter referred to as “each of the instant real estate”) and E-building F on the ground of the real estate listed in the attached list No. 2 (hereinafter referred to as “instant loan”).
However, in relation to the loan of this case where the plaintiffs filed for the registration of ownership transfer against the defendant for the restoration of real name with respect to the loan of this case for which the registration of ownership transfer was completed under the name of the defendant, the court of appeal (Seoul High Court 2018Na2018 or 2019864) shall affix the seal of the plaintiff's employee who was ordered by the defendant or the defendant, and the seal of the deceased's name affixed on the name of the deceased printed on the purchase and sale agreement and the real estate sales contract.
