1. 공갈 피고인은 피해자 B(여, 42세)과 2015. 10. 30.경부터 내연관계로 지내 오던 중, 2016. 1. 28. 18:00경 광주 북구 양산동에 있는 상호불상의 술집에서 피해자와 술을 마시다가 피해자로부터 헤어지자는 말을 듣고는 그 동안 피해자와 만나면서 사용한 돈을 내놓으라면서 그때부터 피해자의 휴대전화에 ‘불륜 사실을 시댁, 남편, 지인들에게 알려 사회에서 매장을 시킨다, 현금 500만원을 입금시켜라’라는 취지의 메시지를 여러 차례 보내어 만일 돈을 보내지 않으면 불륜 사실을 피해자의 주위 사람들에게 알릴 것처럼 협박하여, 이에 겁을 먹은 피해자로부터 2016. 1. 29. 피해자의 지인인 C을 통해 피고인이 지정한 D 명의 계좌로 500,000원을 송금받고, 2016. 4. 14. 위 D 명의의 계좌로 1,000,000원을 송금받았다.
