1.The part concerning the principal lawsuit in the judgment of the court of first instance shall be modified as follows:
The Defendant-Counterclaim Plaintiff (Counterclaim).
Reasons
A principal lawsuit and a counterclaim shall be deemed simultaneously.
1. The reasons why the court should explain this part of the basic facts are as stated in the corresponding part of the reasoning of the judgment of the court of first instance, and thus, they are cited by the main sentence of Article 420 of the Civil Procedure Act.
2. Determination as to the cause of the principal claim
A. The construction cost of the instant case based on the Plaintiff’s assertion is KRW 700,00,000, and the additional construction cost is KRW 141,522,714, which the Plaintiff shall receive from the Defendant, is KRW 841,52,714.
Of the construction cost of this case, the Plaintiff received KRW 384,00,000 from the Defendant, and the Defendant paid KRW 233,201,066 to the Plaintiff’s subcontractor, and the Plaintiff paid KRW 7,049,166 to the Defendant totaling KRW 7,049,166 as the cost of repairing the defects of the construction of this case. Accordingly, if the Plaintiff deducts the Plaintiff from the remainder of the construction of this case, the Defendant is obligated to pay the Plaintiff the remainder of the construction work (=384,00,000 - KRW 384,20,00,000 - KRW 233,201,066 - KRW 7,049,166) and the delay damages therefrom.
나. 추가공사대금 청구 ⑴ 인정되는 부분 ㈎ 갑 제3, 7호증의 각 기재, 갑 제6호증(제6호증의 21은 제외)의 각 영상, 제1심의 감정인 F의 감정결과와 제1심 및 당심의 감정보완결과 및 변론 전체의 취지를 종합하면, 원고는 이 사건 공사 진행 도중에 피고의 추가ㆍ변경공사 요청 또는 승인에 따라 당초 약정한 공사 외에 아래 표의 ‘항목’란 기재와 같은 추가 또는 변경공사를 하였고, 그 공사대금 증감분의 합계액이 136,863,129원인 사실이 인정되므로, 피고는 원고에게 위 돈을 지급할 의무가 있다.
