1. All of the plaintiff's claims are dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Facts of recognition;
A. On September 10, 1978, the Defendant: (a) purchased forest No. 3,277 square meters (10 square meters of forest No. 10 square meters on February 12, 2009; (b) Si, Gyeong-do, Gyeong-do; (c) on October 7, 2011, the land category of which was converted into miscellaneous land; and (d) completed the registration of ownership transfer on November 7, 1978, the number of the remaining land is changed; (c) the land remaining after the division, land category change, etc. was made within 3,277 square meters in Gyeong-do, Gyeong-do; and (d) purchased the land indicated in paragraph (1) of the attached Table (hereinafter referred to as “instant E land”) without being prior to the division, land category change, etc.; and (d) purchased on November 7, 1978.
B. On July 16, 1973, the Plaintiff purchased F forest land 5,752 square meters (hereinafter “F land before the instant partition”) located adjacent to the West-do, Gyeongnam-do, Gyeongnam-do. The Plaintiff completed the registration of ownership transfer on August 3, 1973. On January 16, 1979, the Plaintiff completed the registration of ownership transfer on the portion of F forest land 661/5752 out of the above land on December 5, 1978.
다. 피고는 1979년경 이 사건 E 토지 중 남서쪽 부분을 성토하여 별지 감정도 표시 22, 21, 20, 16, 6, 5의 각 점을 차례로 연결한 선 위 부분 등에 최고 높이 2m 이상의 콘크리트 옹벽(이하 ‘이 사건 콘크리트 옹벽’이라 한다)을 축조하여, 이 사건 E 토지 및 이 사건 분할 전 F 토지 일부를 군부대 및 장교숙소 부지로 사용하기 시작하였고, 이 사건 E 토지 중 별지 감정도 표시 6, 16, 17, 7, 6의 각 점을 차례로 연결한 선내 ㈏ 부분 104㎡ 및 별지 감정도 표시 16, 17, 18, 19, 20, 16의 각 점을 차례로 연결한 선내 ㈐ 부분 31㎡(이하 위 각 토지 부분을 ‘이 사건 토지’라 한다)는 이 사건 콘크리트 옹벽 바깥쪽에, 원고 소유의 별지 목록 제2항 기재 토지 중 별지 감정도 표시 5, 6, 15, 14, 13, 5의 각 점을 차례로 연결한 선내 ㈒ 부분 15㎡ 1979년 당시 원고 소유의...
