1. The defendant shall be the plaintiff.

1. Basic facts

A. On April 19, 2010, the Plaintiff was the owner of 4,096 square meters of C forest land in Seongdong-gu, Changwon-si (hereinafter “C forest land before division”). On April 19, 2010, the Plaintiff divided C forest land into 3,634 square meters of C forest land (hereinafter “C forest land after division”) and 462 square meters of D forest land into 3,632 square meters and disposed of the said D forest to a third party.

B. E was the owner of F-245 square meters (hereinafter “F-land”) and the housing on the ground adjacent to the North Korea’s documents of C forest land prior to the division.

C. The Defendant, who is the E, is the owner of Changwon-si G-gu, Sungwon-si and 324 square meters (hereinafter “G land”) and the “H” on the ground adjacent to the North documents of the C forest land prior to the division.

On December 29, 1998, the Plaintiff and E concluded a sales contract with the following terms (hereinafter “instant sales contract”), and E paid the price in full, because the Defendant’s collection on the F’s housing and G’s land was partly affected by C forest land before the division.

As a result of the boundary surveying conducted by C in December 1997, I included part of C in the lower side of H.

Since it is impossible to purchase and sell land in the green belt, the part (referring to three photographs taken earlier on December 27, 98) of the sewage hole located in the back of the house is used as a black color with a boundary after consultation with the owner of the city and the owner of the city.
