피고인은 2013. 8. 22. 10:15경 광주 북구 C아파트 5동 통로에 주차된 자신의 차량 앞, 뒷유리에 C아파트 경비원인 피해자 D(64세)가 ‘불법주차’라고 적힌 경고장을 붙이고, 피고인에게 관리사무소로 가서 아파트 표시 스티커를 발급받으라는 말을 하자, 피해자에게 “이런 거 붙이지 마랬잖아, 개새끼야”라는 욕을 하면서 손으로 목을 밀쳐 넘어뜨려 폭행하여 피해자에게 약 2주간의 치료가 필요한 경추부 염좌 및 앞 목 부위의 찰과상을 입게 하였다.
