Punishment of the crime

[criminal records] On February 19, 2016, Defendant B was sentenced to four months of imprisonment with prison labor for nighttime building intrusion larceny at the Seoul Northern District Court on July 8, 2016, and the execution of the above sentence was terminated on July 8, 2016. On June 15, 2017, Defendant B was sentenced to two years of imprisonment with prison labor for an occupational embezzlement and was sentenced to two years of suspended execution on April 23 of the same month, and the said judgment became final and conclusive during the suspended execution period.

[Criminal facts]

1. The sole criminal conduct of Defendant A;

A. On February 8, 2018, the Defendant: (a) informed C in the U.S. of the domestic delivery place and the addressee of marijuana; (b) transferred USD 980 to C for import purposes; and (c) C entered approximately 35g of marijuana in the U.S. as the addressee D’s “Seoul Dobong-gu E and F’s intent” in disguised by international express mail; and (d) sent it to the Republic of Korea through international express mail (fO).

On February 8, 2018, the above International Postal Service arrived at the Incheon International Public Port as HI around 19:44.

On February 10, 2018, the Defendant received marijuana delivered to the same purport.

Accordingly, the Defendant imported approximately 35g of marijuana from C.

B. On February 21, 2018, the Defendant: (a) informed C in the U.S. of the domestic delivery site and the addressee of marijuana; (b) transferred USD 970 to C; (c) stated C as the addressee’s J “Seoul Dobong-gu E and Fho” for the purpose of disguised use of approximately 35g of marijuana by international mail; and (d) sent it to the Republic of Korea via international express mail (fO:K).

On February 21, 2018, the above international special mail arrived at the Incheon International Public Port by LM around 13:49.

On February 22, 2018, the Defendant received marijuana delivered to the above purport as Kwikset service.

Accordingly, the Defendant imported approximately 35g of marijuana from C.

On March 3, 2018, the Defendant: (a) informed C in the United States of the domestic delivery place and the addressee of marijuana; (b) remitted the amount equivalent to KRW 4,50,000 to the United States of America; and (c) C, the amount equivalent to the amount of KRW 4,50,000 to
