A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for a period of one year from the date this judgment becomes final and conclusive.

Punishment of the crime

1. 사문서 변조 및 변조사 문서 행사 피고인은 2014. 11. 하순경 인천 남구 C 3 층 피고인의 주거지에서, 행사할 목적으로 권한 없이, 피고인과 피해자 D 사이에 작성된 임대차 계약서 임대차기간의 “2008 년 11월 10일, 매월 八拾萬 원( 월세)” 이라고 기재된 것을 볼펜으로 두 줄로 긋고 “2010 년 11월 10일”, “ 九拾萬 원( 월세)”, “2012. 11. 9.” 로 기재한 뒤 그 위에 피고인의 도장을 날인함으로서 권리의무에 관한 사문서 인 피해자 명의의 임대차 계약서를 변조하고, 2014. 11. 27. 인천 남구 학익동에 있는 인천지방법원에서 그 변조사실을 모르는 위 법원 직원 성명 불상자에게 위와 같이 변조한 임대차 계약서가 마치 진정하게 성립된 것처럼 교부하여 이를 행사하였다

2. On November 27, 2014, the Defendant, who attempted to commit fraud, filed a lawsuit claiming rent of KRW 13,310,340 with the Incheon District Court located in the Nam-gu Incheon Metropolitan City District Court, demanding the victim to pay KRW 13,310,340, and submitted the modified lease contract as evidence.

However, even though the above lease contract was prepared on November 10, 2008 and destroyed by the report on the change of a business operator, the lease contract was modified as stated in the above paragraph (1) for the purpose of receiving rent, etc. from the victim because E did not pay a new lease contract in the name of lessee E even after preparing a new lease contract with the lessee.

As above, the Defendant attempted to defraud 13,310,340 won from the damaged person under the name of rent, etc. However, on August 27, 2015, the Defendant did not receive a judgment from the same court against him/her and did not commit an attempted crime.
