Punishment of the crime

1. No person who violates the Act on Origin Labeling of Agricultural and Fishery Products shall make a false indication of origin or make an indication that may cause confusion as to such indication;

Accordingly, the Defendant made a false indication of origin.

2. The Minister of Food and Drug Safety in violation of the Food Sanitation Act may determine and publicly announce the standards for labels as necessary for national health, and shall not sell, import, display, transport, or use for business purposes, foods, etc., the standards for labels are determined and indicated, unless such standards are indicated;

Nevertheless, from November 7, 2014 to May 26, 2015, the Defendant sold or displayed 270 km salted, 240 km fish, 70 km fish, 30 km fish, 18 km fish, 90 km fish, 40 km fish, 190 km fish, 190 km fish, etc. without indicating the distribution deadline or the quality maintenance deadline.
