1. Defendant C’s 30,000,000 won to Plaintiff A and 5% per annum from October 31, 2015 to May 20, 2016.
Reasons
1. The Plaintiff B is the mother of the Plaintiff and the Defendant C, and the fact that Defendant D is the child of Defendant C is either a dispute between the parties or can be acknowledged by comprehensively taking into account the overall purport of the pleadings.
2. Determination as to loan claims
A. The Plaintiff’s assertion 1) The Plaintiff loaned Defendant C the sum of KRW 300,000,000 per month from June 2001 to December 2003, and KRW 36,000 per month from December 2007 to KRW 1,00,000 per month from around December 2004 to KRW 36,00,00 per month to December 2007 on condition that it shall be repaid if the Defendant D was a professional farmer. (2) The Plaintiff lent Defendant C the sum of KRW 30,00,000 per month to Defendant C’s credit card payment title, and Defendant D agreed to pay it jointly and severally.
3) Around 2004, Plaintiff B lent KRW 40,000,00 to the Defendants, and the Defendants used them for the payment of their deposit for lease. (B) In full view of the respective entries and arguments in Plaintiff A’s 45,000,000 won as to Plaintiff A’s claim, Defendant A may recognize the fact that Defendant A remitted the following money to Defendant C’s financial institution account.
