1. The Defendant shall pay to the Plaintiff KRW 42,00,000 and the interest rate of KRW 20% per annum from April 11, 2015 to the date of complete payment.

Comprehensively taking account of the purport of the entire arguments in Gap evidence Nos. 1 and 2, the plaintiff loaned KRW 45,00,000 to the defendant from November 26, 2002 to July 13, 2004; the defendant paid the above borrowed amount to the plaintiff on August 23, 201; however, if the payment is delayed, the defendant agreed to pay the borrowed amount immediately; the defendant delayed the payment of the borrowed amount on November 201.

According to the above facts of recognition, the defendant is obligated to pay 42,00,000 won with the borrowed principal deducted from 3,000,000 won paid by the plaintiff and delay damages calculated at the rate of 20% per annum from April 11, 2015 to the date of full payment, which is the day following the delivery of a copy of the complaint in this case.

Therefore, the plaintiff's claim of this case is reasonable, and it is decided as per Disposition by the assent of all participating Justices.
