1. The defendant shall be punished by imprisonment for eight months;

2.Provided, That the execution of the above sentence shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

"2013 Highest 1638"

1. Around September 12, 2012, the Defendant said that the Defendant would purchase Samsung E’s one unit of Samsung E in the F office operated by the victim E in the fourth floor of the D building in Busan Jin-gu, Busan.

However, in fact, the defendant did not have the intention or ability to pay the price, and was thought to sell Nowon-gu as used goods and use it for living expenses.

Ultimately, the Defendant, by deceiving the victim as above, obtained 10,290,000 won in total from around 10 times to May 10, 2013, and acquired Not North Korea and Ampids worth KRW 10,290,000 in total market price from around 10 to around 10,000, as described in the attached crime List (1).

2. On December 24, 2012, the Defendant attempted to sell online goods, and attempted to commit fraud, the Defendant expressed to the effect that, from the PC room on December 24, 2012, the victim H posted an article on the part of the victim H to the effect that he/she is going to go to the Nopt by accessing Internet NA G car page, and that he/she would send the Nopt North Korea to the face-to-face by communicating the price to the victim H.

However, even if the defendant receives the payment from the victim, he did not have the intention or ability to reduce the goods.

Ultimately, the Defendant, as such, by deceiving the victim, received 4,340,000 won from the victim’s Busan Bank account in the name of the Defendant on the same day, and attempted to acquire or defraud 8,220,000 won through a total of seven times from around that time to May 14, 2013, including the transfer of 4,340,000 won from the victim’s Busan Bank account in the name of the Defendant.

Around January 14, 2013, the Defendant posted a letter stating that he would sell Rot North Korea on the Internet NAV G Caf, and reported this fact to the victim I who visited 1,300,000 won, “I will deliver Rot North Korea through Kwikset Services if deposit is made.”

However, the intention or ability to sell Nowon-gu is true.
