A defendant shall be punished by imprisonment for one year.
Reasons
Punishment of the crime
The defendant is an employer who operates a D Co., Ltd. with the second and second floor at Jeju, and operated a marine transportation business using 17 full-time employees.
1. Violation of the Labor Standards Act;
A. The Defendant, even from September 3, 2012 to January 4, 2013, employed and worked F at the above D Seoul Branch Office located in Geumcheon-gu Seoul Building 1019, and did not pay KRW 10,400,000, and did not pay wages within 14 days from the date of retirement without an agreement between the parties.
B. The Defendant, from November 1, 2012 to December 21, 2012, did not pay wages of KRW 4,574,850, and did not pay wages within 14 days from the date of retirement without an agreement between the parties concerned, even though he/she had hired G at the above D Seoul Branch Office.
C. The Defendant, from June 26, 2012 to December 24, 2012, had the said D Seoul Branch Office employ and work for H, and did not pay wages of KRW 12,719,440, and paid wages within 14 days from the date of retirement without an agreement between the parties.
The Defendant, from July 1, 2012 to December 21, 2012, employed I and had them work at the above D Seoul Branch Office, but did not pay 15,01,160 won of wages and 14 days of retirement without an agreement between the parties concerned.
E. The Defendant, from June 1, 2012 to December 21, 2012, did not pay wages of KRW 15,025,520 to the above D Seoul Branch Office without any agreement between the parties within 14 days from the date of retirement.
F. The Defendant, from February 20, 2012 to December 21, 2012, employed K and had it work at the above D Seoul Branch Office, but did not pay wages of KRW 21,495,180, and did not pay wages within 14 days from the date of retirement without an agreement between the parties.
G. The Defendant, from July 1, 201 to December 21, 2012, employed L from the above D Seoul Branch Office to have it work, and wages of KRW 35,295,340 shall be from the date of retirement.
