A defendant shall be punished by imprisonment for one year.
Reasons
Punishment of the crime
1. Larceny;
A. On September 28, 2014, the Defendant: (a) around 17:48, 17:48, set up a 315 national bank private home-type 365cop in Jung-gu Seoul Central Bank; (b) subsequently, the Victim C opened a bank’s business on the ATM device, and discovered and steals one of the Korean V cards owned by the victim.
B. From February 10, 2015 to 00:01 on the following day, the Defendant discovered that the victim D was under influence of alcohol within the subway 2 line electric dynamics operated in the direction of the viewing station in the subway station, and cut off cash of 30,000 won, credit cards (three, three, three, three, three, three, and one driver’s license from the main machine of the victim’s occupation.
2. Fraud and violation of the Specialized Credit Finance Business Act;
A. On September 28, 2014, the Defendant, at around 18:38, 2014, displayed the same attitude that he/she was the legitimate holder of the Korean V cards (Credit Card Number H) that he/she stolen to the victim G, who is a business owner, as the above paragraph 1(a) of the same Article, and then purchased two gold galings equivalent to KRW 610,000 from the victim, used stolen credit cards by settling the price with the above credit card, and acquired two gold galings and acquired them.
B. On February 11, 2015, at the J convenience point located in Seodaemun-gu Seoul, Seodaemun-gu, Seoul on February 11, 2015, the Defendant, at around 00:05, had shown the same attitude that he was a legitimate holder of the Samsung Card (Credit Card Number K) that he was stolen, as in the above paragraph 1(b), to his employees, who were not aware of the name, and had it purchased the tobacco to be 22,500 won from the victim, and paid the price by the said credit card, thereby using the stolen credit card, and acquired the said five cigarettes of the tobacco.
