The defendant is not guilty. The summary of the judgment against the defendant shall be published.
Reasons
1. The summary of the facts charged is that the defendant is the pastor of the E church located in Seocheon-gu, Seocheon-gu D, and the victim F is the head of the above church.
A. In around 14:00 on March 9, 2014, the Defendant heard about 100 the church believers in the above E church, the Defendant: (a) reported the victim’s reputation by publicly pointing out false facts, and damaged the victim’s reputation on March 16, 2014; and (b) reported the victim that “I would not know about 100 new teachers of the above E church to enter the church before the clerical error, and to see the church; (c) collected the church in one church, which he had as the head of the church; and (d) confirmed directly the church that I had as the head of the F; and (e) reported the victim’s reputation by publicly pointing out about 100 children of the above church to enter the church, who was not the head of the E church, but the head of the E church, who was not aware of the fact that I would not know about the 7th of the clerical error in the past; and (e) reported the victim’s reputation to the head of the E church.”
B. The Defendant, around 14:40 on May 19, 2014, listened to the victim F with a number of believerss in the fourth-story corridor and the Western city of Seocho-gu Seoul Central District Court of Seoul, Seocho-gu, Seoul Central District Court about 4:0 on the 19th of May 19, 2014.
The honor of the victim was damaged by openly pointing out false facts at a church, stating that it is “influence to the guidance that he was the head.”
2. Determination
A. As evidence consistent with the above facts charged as to defamation on March 9, 2014 and defamation on March 16, 2014, there was a witness F and G’s respective legal statements and an investigative agency’s statement. They were false facts as indicated in the above facts charged at the preliminary inspection of the Defendant, who is a pastor of the E church, on March 9, 2014 and on March 16, 2014.
