1. The punishment of the defendant shall be determined by six months;

Punishment of the crime

On November 27, 2013, the Defendant was sentenced to eight months of imprisonment for a crime of fraud at the Daejeon District Court, and the said judgment became final and conclusive on February 27, 2014. On October 16, 2014, the Defendant was sentenced to one year of a suspended sentence of imprisonment with prison labor for the same crime at the Daejeon District Court, and the said judgment became final and conclusive on February 26, 2015.

The Defendant, while operating C Co., Ltd., subcontracted the studio Construction Work D at Jin-si on January 13, 2013 to E.

피고인은 2013. 9. 16. 경 당 진시 D에서 원룸 B 동 건축 주인 피해자 F에게 “ 당신이 창호 시공업자인 G에게 지급하기로 약정한 공사대금 6,354만 원에 대하여 내가 G과 합의하에 창호 샷 시 공사대금을 4,700만 원으로 정리하고 이미 이를 G에게 지급하였으니, 나에게 4,700만 원을 주면 된다.

“A false representation was made.”

그러나 사실은 피고인은 G 과의 사이에 창호 샷 시 공사대금을 4,700만 원으로 합의하거나 G에게 4,700만 원을 지급한 사실이 없었고, 피해 자로부터 창호 샷 시 공사대금 명목으로 돈을 받더라도 이를 G에게 지급할 의사나 능력이 없었다.

피고인은 이와 같이 피해자를 기망하여 이에 속은 피해 자로부터 같은 날 창호 샷 시 공사대금 명목으로 4,700만 원을 피고인이 사용하는 H 명의의 우체국 계좌 (I) 로 입금 받았다.
