1. Basic facts

A. On July 6, 2010, the Plaintiff had a plan to produce the film “C” in the drama and entered into a contract with Dramper Co., Ltd., Ltd., a copyright holder of the film “C” with the Plaintiff’s exclusive use of the film for five years. (1) On October 3, 2012, the Plaintiff entered into a contract for joint production and investment of the instant drama jointly manufacturing and investment with the Defendant, who had not been fully in possession of the production cost of the instant drama. On October 3, 2012, the Defendant and the Defendant paid the Plaintiff the production cost of the instant drama, and the Defendant managed the Defendant’s income related to the sales of the instant drama, by settling accounts for sales and expenses at the rate of 50:50 (hereinafter “instant contract”).
